Inadmissibility Hearing & Residency Obligations of a Permanent Resident of Canada

Author: Jagpreet Puri

One can be asked to appear for an Inadmissibility Hearing if his/her residency obligations to become a Permanent Resident of Canada have not been met. This encompasses having resided in Canada for at least 730 days during the last five years. These years do not have to be continuous, just cumulative.

Some of your time abroad may count towards the 730 days, however, these exceptions must be understood in detail if you have to document the situation.

If you have not met residency obligations while applying for extension of a PR Card or at the Point of Entry, you might have to appear for an Inadmissibility Hearing. There is a possibility of a Permanent Resident of Canada losing Canadian Immigration Status due to not meeting Residency Obligations.

If there was any emergency, you must have genuine proof of that extraordinary situation that kept you away from Canada to explain during the hearing.
